Welcome to SimpTok! By accessing or using the SimpTok web application (the “Service”), you (the “User”) agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, do not access or use the Service.
These Terms are a legal agreement between you and the provider of the SimpTok Service. We reserve the right to modify or update these Terms at any time, and any changes will be reflected in this document. By continuing to use the Service after such changes, you agree to be bound by the updated Terms.
1. Account Registration and Access

We take reasonable steps to protect the security of your data, but we cannot guarantee its absolute security.
2. License to Use the Service
2.1 Grant of License
Upon agreeing to these Terms, SimpTok grants you a non-exclusive, non-transferable, and revocable license to use the Service. This license is limited to personal and commercial use as intended for analyzing TikTok Shop data. You may not sublicense, assign, or transfer the license to any third party.
2.2 Restrictions on Use
You may not use the Service in any manner that violates applicable laws or regulations. Additionally, you may not use the Service:
- To infringe upon or violate the intellectual property rights of others;
- To exploit, harm, or deceive other users;
- To engage in any illegal activities or encourage others to do so;
- To manipulate or misappropriate the data provided through the Service;
- To interfere with or disrupt the functionality of the Service or any associated servers or networks.
2.3 Prohibited Activities
By using the Service, you agree not to:
- Engage in any activity that could compromise the security of the Service or other users’ data;
- Distribute any viruses, malware, or harmful code;
- Attempt to reverse-engineer, decompile, or disassemble the Service or its underlying technology;
- Engage in scraping, data harvesting, or other unauthorized collection of data from the Service.
3. Data Usage

The data collected and analyzed through the Service, including TikTok Shop analytics and any associated reports or insights, belongs solely to you or your organization. SimpTok does not claim ownership of this data. You retain full ownership of the data that you upload or input into the Service.
3.2 Data Privacy and Sharing
SimpTok values your privacy. We do not sell, rent, or share any data provided through the Service. All data you upload or generate is solely used to deliver the analytics and insights requested by you. SimpTok does not share your data with third parties unless required to comply with applicable laws or regulations.
3.3 Data Retention and Deletion
We will retain your data for as long as necessary to provide the Service, fulfill legal obligations, or resolve disputes. You may request the deletion of your data at any time by contacting us directly. Upon your request, we will delete your account and any associated data from our systems, subject to legal retention requirements.
4. Service Availability and Modifications
4.1 Service Availability
We strive to ensure that the Service is available 24/7, but we cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances. We will make reasonable efforts to notify users of planned maintenance.
4.2 Modifications to the Service

5. Limitations of Liability

SimpTok provides the Service “as is” and “as available” without any warranties, either express or implied, regarding the accuracy, completeness, reliability, or availability of the Service. We make no representations about the suitability, reliability, or performance of the Service for any specific purpose.
5.2 Limitation of Liability
SimpTok will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim related to the Service will be limited to the amount you paid to access the Service in the 12 months preceding the claim.
6. Indemnification
You agree to indemnify, defend, and hold harmless SimpTok, its affiliates, employees, agents, and partners from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any rights of third parties.
7. Termination
7.1 Termination by You
You may terminate your use of the Service at any time by deactivating your account and ceasing to use the Service. Any fees paid are non-refundable.
7.2 Termination by SimpTok
SimpTok reserves the right to suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. Upon termination, all rights granted to you under these Terms will immediately cease.
8. Miscellaneous
8.1 Governing Law
These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which SimpTok operates, without regard to its conflict of law principles.
8.2 Dispute Resolution
Any disputes arising out of or related to these Terms or the Service will be resolved through binding arbitration, rather than in court. The arbitration will take place in the jurisdiction where SimpTok operates, and the rules of arbitration will govern the process.
8.3 Severability
If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
8.4 Entire Agreement
These Terms, along with any policies or guidelines incorporated by reference, constitute the entire agreement between you and SimpTok regarding the use of the Service.
